Lawsuit filed against C and D Landscape Co. and one of its employees

PORTLAND, Ore. (KOIN) — A $2.7 million dollar wrongful death lawsuit was filed by the family of an 85-year-old man killed while on Highway 99.

The crash happened on September 21 along Hwy 99 near the intersection of Stoller Road.

On Wednesday, the lawsuit was filed against C and D Landscape Co. and one of its employees.

According to the lawsuit, Antonio De Jesus Sanchez Guillen was driving a 2007 Ford F-250 that was owed by the landscaping company at the time of the crash.

The lawsuit claims, “as a result of the negligence of the defendants, the defendant’s truck and trailer veered into” the lane Richard and Velda Mitchell were using.

The crash killed Richard and reportedly left Velda with permanent injuries.

The lawsuit alleges that Guillen was driving too fast and was unable to maintain reasonable control of the truck.

Attempts to reach Guillen and C and D Landscape Co. for comment were not immediately successful.
