PENDLETON, Ore. (KOIN 6) — An inmate serving time for robbery, identity theft and negligent homicide was shot to death by a guard at the Eastern Oregon Correctional Institution.
Around 9 a.m., officials said, two prisoners were assaulting another inmate. They did not stop fighting, and a prison guard fired from a yard tower.
The bullet hit Jayson Matthew Withers, who was pronounced dead at 9:21 a.m. Withers had been in prison since 2000, and his earliest release date was November 2018.
The attacked inmate was taken to a hospital for treatment. The third prisoner is in disciplinary segregation, officials said.
The name of the officer who fired the shot has not been released. The case is now with the Umatilla District Attorney.
