VANCOUVER, Wash. (KOIN) — No charges are in store for the Skyview High School student accused of taking a photo up his teacher’s skirt with a mobile phone, according to the Clark County Sheriff’s Office.

The boy was not charged with voyeurism because a deliberately sexual intent — behind a teen taking a photo up a woman’s skirt — could not be proven.

“We can’t prove that the kid took the picture with sexual motivation and that is the letter of the law,” said Clark County Sheriff’s Office Sgt. Sam Gardner.

“The [district attorney] couldn’t prove motivation in this case.”

Because the DA couldn’t prove the student’s intention, prosecutors could not move forward with criminal charges.

Gardner said the student was disciplined by the school, but was unable to disclose details.
