Actions of injured officer who shot, killed suspect justified

PORTLAND, Ore. (KOIN) — A grand jury determined on Monday that the deadly force an officer used against a suspect  was justified under criminal law.

Officer John Romero shot and killed Kelly Vern Mark Swoboda during a confrontation with police near Woodrow Wilson High School on Mar. 12.

Romero shot at Swoboda after Swoboda fired a shot at him just after 4 p.m. when Portland Police Youth Services officers and Central Precinct officers responded to the area near the high school on reports of a man driving a suspicious vehicle.

Earlier in the day on Mar. 12, Portland police said in a statement students walking home from Southwest Portland schools had been followed by a man acting in a suspicious manner driving a blue van.

One of the schools was Woodrow Wilson High School.

Police said additional patrols had been provided to the area and officers were in the process of investigating the incidents.
