HILLSBORO, Ore. (AP) — A diabetic driver who passed out and crashed into an Aloha yard, killing an 11-year-old girl, will not be charged.

The Washington County district attorney’s office says the sheriff’s office investigation of 60-year-old David Herman found no criminal wrongdoing.

The Oregonian reports Herman is a science teacher at Liberty High School in Hillsboro who checks his blood sugar regularly, takes insulin and did not have a history of blackouts.

The crash on April 4 killed Kylie Hornych as the car smashed into her home. Herman remained at the scene.

Prosecutors called it a tragic accident.
